4 Benefits of Divorce Mediation

But whether they are ready to divorce or not, people will often be blindsided by the legal complexities and financial costs of dissolving their marriage.

Divorce can be expensive and difficult, but one way to make the process easier is through mediation. If couples are able to work together with a trained mediator to resolve the issues in their divorce, they can complete the process much more quickly and efficiently.

Consider the following four benefits of divorce mediation:

  1. Cost - A traditionally litigated divorce can be very expensive, with each spouse paying their lawyer to prepare documents, send communications, discuss issues, and attend court. During mediation, spouses will usually split the mediator’s fees, and even if they spend multiple sessions working out an agreement, the total cost can be 40-60 percent less than a traditional divorce.

  2. Efficiency - By working with a mediator, couples can make sure all the necessary legal issues are settled, including the division of assets and debts, the allocation of parental responsibility, and the creation of workable parenting time schedules, without the need to coordinate availability for court dates with their lawyers and the judge. A resolution can typically be reached much more quickly using mediation, allowing spouses to finalize their divorce and move on to the next stage of their lives.

  3. Confidentiality - Everything discussed during mediation is private and confidential and, at its conclusion, couples will be able to attend court to finalize the divorce process. By avoiding court battles, couples can keep their disagreements out of a public forum, providing them with more dignity during what can be one of the most difficult and stressful times of their lives.

  4. Benefits for children - Mediation encourages cooperation and compromise, which are skills that divorcing parents will need to develop as they continue to work together to raise their children. By reducing the stress of the divorce process and focusing on the children’s best interests, mediation will provide a better atmosphere for kids in both their parents’ homes.

While mediation can be a great solution, it does require spouses to be able to work together and compromise as they try to reach a resolution that will be acceptable to both parties. If one or both spouses refuse to budge on certain issues, then mediation may ultimately be a waste of time and money. But, if couples can try to see things from each other’s perspective and work toward a common goal, they will find that mediation is a great way to get through the difficult divorce process.
